Task coordinating functionality of Samsung Galaxy S II | We Do ...

The Galaxy S II is perfect for handling top organizational features. It is in the values that are built in now, with more to come in the future, of connectivity and operating features in the DLNA compatibility environment. Thanks to its already built-in features this cell phone really represents an outstanding quality in every possible ways. By way of brief background, the DLNA (which stands for Digital Living Network Alliance) was formed in 2003. The alliance forms a strong bond between its international members.

They have agreed to link products by making them compatible. DNLA have almost 250 international members. The fields of manufacturing include electronics designers and manufacturers, computer makers; and as here, mobile communications device makers. DLNA also includes many major component suppliers where the value can be engineered and most important, software developers whose work ties the hardware designs together.

The DLNA companies create new products that work together in a manner greater than the individual parts. The designs contain open standards or other specifications which they share with each other. The collaboration embodies in meetings where members discuss their new developments and the future horizons of business opportunities. As a result of collaboration we can get to see and use several products being greatly compatible with each other. The cell phone industry is currently the most ideal for joint developments. Protect your device with the Samsung Galaxy accessories such as the Samsung Galaxy S II case or the Samsung Galaxy S II screen protector especially to raise the life expectancy of your mobile with proactive protection. The accessories of the cell phone will help you to out-mine all the possibilities that lie in this great phone.

Another organizational feature of the Samsung Galaxy S II is the video and camera system. The Galaxy S 2 has an eight (8)-megapixel camera, which produces full and rich images through its high quality sensor. Watching video from this camera, most are impressed with the rich quality of the images, the photographic depth of field, sharpness of the details. The camera and video capacity and quality is on a professional level, you will be surprised how a phone can have such professional quality features. Most users have been impressed with Samsung?s lenses and video cameras.

You need no experience in making great photos with this cell phone. The software of the camera offers several setting options for the users. There are many and varied color effects, several levels of image quality with manual settings. The camera software does its best to bring out the best of the pictures and videos you take; there are advanced features like Outdoor Visibility, Anti-Shake, and Blink detection. Even when moving and panning from place to place, there will be a well-focused and shake-free image on the screen, the telltale sign of cell phone video simply not there; in its place, a video quality associated with high quality recorders. The screen protector for Galaxy S II and travel charger for S II are part of the many accessories found at Galaxy S2 Source.

Use Samsung Galaxy S2 Epic 4G Touch accessories to help your phone out. Accessories like Samsung Galaxy S2 Epic 4G Touch car mounts and Samsung Galaxy S2 Epic 4G Touch cleaning kits will get the job done.

Antivirus Software - Protecting Your Computer's Data | Espacio Tech

When you buy a new computer you must protect your investment from malicious software programs such as viruses, worms, spyware, and trojans. These programs can cause serious damage to your computer system by erasing data or providing your sensitive data to criminals. You can help protect your personal computer by installing antivirus software to remove and prevent nasty viruses and spyware.

There are various antivirus programs available on the market and while they all do the same job, there are several things to keep in mind when choosing a program.

First you will want to consider the ease of use of the software. The average computer user is not tech savvy so you will want your antivirus software to be very user friendly. Look for features such as easy configuration as well as scanning your system on demand. The software should also automatically check for updates.

A good antivirus program will also be able to remove dangerous viruses, trojans, and worms and prevent new ones from infecting your computer. If the program cannot completely remove these viruses, it should at the minimum be able to keep the virus from spreading.

It is also important to ask if the software is a system hog. Many antivirus programs can use up a lot of your computer?s resources slowing down your system. This can cause problems if you plan on running your antivirus software in the background while you continue to work. There are many good programs available that use resources more effectively. They run unnoticed in the background while you continue to work normally.

Some antivirus programs do include spyware prevention but in order to be fully protected, you may opt for purchasing separate spyware software as well. A separate spyware program can help ensure that your computer is safe from spyware issues that a combo program may not be equipped to catch.

NHL lockout could mean happy returns for ticket ... - Financial Post

There?s not much that could convince me to become a Toronto Maple Leafs fan ? except maybe a 5% return.

A diehard Buffalo Sabres fan, I received notice from my team this month that in the event of a labour dispute in the National Hockey League I could get a refund on my purchased tickets. The players have been locked out since last week.

My beloved Sabres, who are owned by a billionaire, said if I let them hold onto my money they would pay me annual interest of 4%, which would start accruing after the games I purchased were cancelled.

Much to my chagrin, the Leafs are offering an even better rate to their season ticket holders.

?Leafs season ticket holders have an option: They can choose to be refunded monthly, should games be cancelled, and receive 1% interest, or they can leave their money on account where they will earn 5% interest,? said Pat Park, director of media relations with the team.

Across the NHL, it seems fans are being presented with this magical investment opportunity ? to get a return on their funds that any pension fund manager would be happy to accept.

The Vancouver Canucks are offering up to 3%. Likewise for the Winnipeg Jets, Calgary Flames and Montreal Canadiens. The Edmonton Oilers might be checking out hockey rinks in Seattle for a new location but for now their fans will be getting a 4% return on their money.

But nothing beats the cash being handed out south of the border where reports have circulated that have both the Florida Panthers and Minnesota Wild offering a meaty 10% return for fans if they let their cash ride with the team.

The money on file, with the accumulated interest, is eventually used to pay for future tickets ? assuming they play hockey again.

We hope it?s a short lockout so we don?t spend our time and energy refunding a game here and a game there

So why are the teams offering a rate of return I can?t possibly get on a guaranteed income certificate? For the most part it seems to be goodwill but also the hassle of returning all that money.

?We have had tremendous fan support since the start of our franchise,? said Aaron Sickman, a spokesman for the Minnesota Wild. ?They?ve been coming back to us in droves and we want to encourage our fans to keep their money with us. We hope it?s a short lockout so we don?t spend our time and energy refunding a game here and a game there.?

Marc Ganis, a sports consultant and president of Chicago-based SportsCorp Ltd., laughs when I tell I?m thinking of getting Wild season?s tickets and betting on a prolonged strike. ?That?s pretty impressive,? he says, about the 10% rate, adding the risk is probably minimal because he can?t remember the last time ticket holders lost their money because of a bankrupt franchise.

Mr. Ganis says the administration cost of refunding tickets is one reason why teams will pay interest to keep fans but he said the high rate might be seen as positive indicator the delay may be short. ?By doing this, it?s not a lot of money and it looks good on them,? he says. ?For this type of interest, I?d let the money roll.?

Certified financial planner Ted Rechtshaffen says it probably makes sense to leave your money with the team, if you know you are coming back to hockey when the labour dispute is over. ?The bottom line is do you want your money or do you know you are going to buying the tickets anyway, then it?s gravy,? says Mr. Rechtshaffen.

Of course, all of this is based on the premise that the underlying tickets were a worthwhile investment to begin with. ?If I was advising someone, I?d say 10% interest is great but then you turn that money into $150 hockey tickets which may or may not be the best investment,? he says. ?It?s only 10% on money that is 100% committed to buying hockey tickets.?

Maybe it?s time to just forget about buying hockey tickets. That might be the best investment I ever make.

SevOne: The Dismal And Hopeful State Of Data Center Performance

datacenterThe data center is a mess. They consist of old physical networks, endless snarls of cables and storage boxes the size of refrigerators that stand in contrast to the comparable elegant world of the web. We love the web. The data centers ... not so much. But a new study by SevOne gives a bit of hope by illustrating that the new way we think of data may make life a bit better for those hardy souls who spend their days toiling between the rows of machines inside the walls of the enterprise data center.

Facebook: Is there a way of getting the current_location of users who are not my friends? Graph API or FQL

Let's imagine I have a user ID and username. I manually open her Facebook page (namely, http://www.facebook.com/username. And there it is! The "lives in" field appears saying she lives in wherever. Nevertheless, when I try to fetch her current_location using FQL (using Python):

q = 'SELECT uid, username, current_location FROM user WHERE uid=%s' % aUser

I get None in the field current_location.

On the other hand, I can easily retrieve the current_location from my friends (I mean, for those friends who have made their location public):

SELECT current_location FROM user WHERE uid IN (SELECT uid2 FROM friend WHERE uid1 = me())

I know about the permissions, but there should be a way of fetching locations. In effect, I can see the location (lives in) of user who are not even friends of my friends. How can I do it?? Thanks in advance.

Steps through which you can implement Health & Safety Training ...

by pat brownlee on September 23, 2012

Sent by Jayanta Chatterje

Business owners should ensure that every employee working within the organization is provided with a safe environment so that in case of any accidents the employees should have the complete knowledge of the preventive measures. The organization has certain legal obligations due to which they are bound to provide with the safety training to their employees. But, if any organization fails to provide the training and maintain the safety then they are subject to prosecution and it might also happen that they are charged with a heavy compensation amount and in worst condition the company can also be subject to shut down.

But, it is also essential to understand that the law is not the only obligation for which you should provide health and safety training to your employees. It is the best way through which you can improve the productivity and also provide a good and secured life to your workers. You can easily improve the revenue and earn more profits as the employees suffer from less illness and injury and this contributes to the overall improvement of the workplace. It is found that in a year millions of people get injured in their workplace and? in order to avoid such situations, ?it is essential on the part of the organization to ensure a safer environment.

There are certain steps through which you can implement the health and safety training in your organization:

  • It is essential to understand the requirement of the organization and should search for the skills and the knowledge that is necessary for the employee to work in the particular organization. It is the duty of the organization to understand the skills that the employee possesses and the skills that the company needs and work on the necessary field to reduce the gap.
  • The company should also prioritize the training and understand the requirement of the health and safety course within the organization. It is the duty of the organization to focus on the area where there is a lack of information and should provide training in that particular area so that the employees can enhance their skill as well as their knowledge.
  • The organization should also adopt the proper training method so that the employees can learn every aspect of safety and can be sure to implement them while the necessity arises. There should be proper classrooms, coaching centers, information passing mechanism and is also provided with improved interactive training so that every employee can have a better understanding of it.

Organizations that involve high risk jobs have to spend huge amounts of money on their employees, as everyday some or the other person gets injured and die due to the careless handling and lack of knowledge on how to perform their duty in the workplace. Providing safer working environment can reduce the absence of the workers and improve the productivity that will lead to the ultimate revenue generation of the business. A sense of security among the employees can lead to the improvement of the business and help them to perform and reach the desired goal.

Another important responsibility of every company is to ensure that they provide the correct personal protective equipment that fits each particular job.? Employees must be trained to wear their PPE at all times, keep it maintained, and ask for a replacement when it is damaged. pb

Mursi: Egypt-Israel peace depends on justice for Palestinians

CAIRO (Reuters) -- Egyptian President Muhammad Mursi told US media the country's peace deal with Israel depends on fulfilling its commitments to Palestinians, in comments published on Sunday.

Speaking before traveling to New York for the UN General Assembly, Mursi said Washington needed to change its approach to the Arab world, show greater respect for its values and help build a Palestinian state to reduce pent up anger in the region, the newspaper said.

"As long as peace and justice are not fulfilled for the Palestinians, then the treaty remains unfulfilled," he said in an interview with the New York Times, referring to Egypt's US-brokered peace treaty with Israel that was signed in 1979.

Mursi, who travels to New York on Monday, is not scheduled to meet Obama during his US trip. When asked whether he thought of the United States as an ally, Mursi said: "That depends on your definition of ally."

Egypt was a close ally of the United States under Hosni Mubarak, whose 30-year rule was ended by a popular uprising last year. The US government, a major aid donor to Egypt and long wary of Islamists, only opened formal contacts last year with the Muslim Brotherhood, the group that propelled Mursi to power.

US President Barack Obama told a Spanish-language network this month that the United States did not consider Egypt's Islamist government either an ally or an enemy.

The New York Times also said Mursi indicated Egypt would not be hostile to the West but would not be as compliant as Mubarak.

"Successive American administrations essentially purchased with American taxpayer money the dislike, if not the hatred, of the peoples of the region," he said, referring - according to the newspaper - to backing dictatorial governments over popular opposition and supporting Israel over the Palestinians.

A spokesman for Mursi could not immediately be reached for comment, nor could a US embassy official.

Ahead of Mursi's trip,Obama thanked the Egyptian president for securing the US Embassy during protests against a film made in the United States that mocked Prophet Muhammad and sparked worldwide demonstrations and violence.

In a letter, Obama repeated Washington's condemnation of the film and said he looked forward to working with President Muhammad Mursi to build on the "strategic partnership", Mursi's official Facebook page said on Sunday.

"In his letter, President Obama thanked the Egyptian president for Egyptian efforts to secure the mission of the United States in Cairo," according to the site.

Obama's rival in the US presidential race, Mitt Romney, called for a tougher line with Egypt after protesters scaled the compound wall and tore down the US flag on Sept. 11.

Police clashed with demonstrators for four days after that incident and barriers were erected to stop them getting near the compound.

Marco Polo Davao: Business and Pleasure in Southern Philippines ...

THE Marco Polo Davao?s luxurious accommodations and amenities are quite simply the finest in Davao City, making it a favorite for business travel in the southern Philippines.

The lobby at Marco Polo Davao. Pic: Mike Aquino.

The lobby at Marco Polo Davao. Pic: Mike Aquino.

The luxury comes at a premium, though, but look what the higher rates get you: convenient downtown location, fine dining at the mezzanine-level Club Marco, endless lifestyle diversions at the fourth-floor Deck, and comfortably classy accommodations with views of the mountains or the Davao Gulf.

What makes it special?

The Marco Polo Davao?s location at busy Claro M. Recto Street places the hotel (and its guests) right in the middle of the action: only 20 minutes away from the airport, the hotel stands at one end of Davao City?s most prominent commercial avenue and across the street from souvenir-rich Aldevinco Shopping Center.

If you?re a businessman staying at the Marco Polo, expect Davao?s business to come to you: the hotel is a favorite watering hole for the city?s movers and shakers.

The hotel?s first-class amenities draw them in ? the Marco Polo Davao has some of the city?s finest dining establishments under its roof, including the Polo Bistro, which serves up Angus tenderloin steaks and an irresistible grilled blue marlin; the Cantonese restaurant Lotus Court; the ground-floor Eagles Bar; and the Caf? Marco, with its massive buffet and a la carte spread.

The pool lounge at Marco Polo Davao. Pic: Mike Aquino.

What to expect?

The Marco Polo Davao?s 245 guestrooms and suites have been designed along modern lines, with a Filipino touch. The d?cor is rich in creams and greens, reflecting Davao City?s natural hues. Large windows in every room open up to views of the Davao Gulf or the mountains around the city.

For enhanced pampering, try the Continental Club Rooms on the 17th floor and 18th floors ? Continental Club guests enjoy a range of exclusive perks, like personalized registration in a separate lounge; complimentary breakfast, afternoon tea and cocktails; and butler service.

What is there to do?

The Marco Polo Davao?s lifestyle amenities have all been aggregated on the fourth-floor Deck: an outdoor podium that houses the hotel?s 25 m swimming pool, fitness center, and the Lazuli Spa. The Sarangani Function Room and the Polo Bistro Pool Lounge can also be found on this level ? the latter is a great place to have drinks while the sun sets.

The lap pool at Marco Polo Davao. Pic: Mike Aquino.

The fitness center covers two levels of exercise space, including an aerobics floor and new gym equipment. Beside the gym, the two-storey Lazuli Spa offers four treatment rooms and one couple?s room.

If you want to stay close to all this fun, book a cabana room on the fourth or fifth level; these accommodations give you the choice of a patio (for 4th-floor cabana rooms) or a balcony (for 5th-floor cabana rooms) that look out to the Deck and its activities.

What is the damage?

The superior and deluxe rooms at the Marco Polo Davao go for between US$92 to US$117, with early-bird deals and seasonal specials available. You get comfortable business-class accommodations, with the aforementioned panoramic view of the city, but WiFi is not free and requires an additional payment if you want to get the password.

Pacific Business News editorial supports university's Hawaii ...

UH?s Innovation Initiative is talking real money

?Managing Editor?s Notebook by Jim George published in the September 21, 2012 issue of Pacific Business News

?A billion here, a billion there, and pretty soon you?re talking real money.?

That famous quote, attributed to the late U.S. Sen. Everett McKinley Dirksen, may well be an urban legend. The Dirksen Congressional Center says there?s no record of the Republican senator from Illinois ever coining that phrase to express his disdain for federal spending.

But it?s a good one. And, despite the implied sarcasm, a billion dollars is still real money if it?s in the right place for the right reasons.

Peter Quigley knows this. As executive director of the University of Hawaii Innovation Initiative, he has his sights set on one billion dollars. That?s the amount of money he wants UH to attract in federal research grants within the next eight to 10 years.

UH already is about halfway to that goal. During a two-year period ? fiscal years 2010 and 2011 ? 86 UH researchers, known as principal investigators, each received awards of at least $1 million for an approximate total of $456 million. Eleven researchers accounted for about 30 percent of that total.

In a 2009 report, UH ranked 51st out of 689 public and private universities in research expenditures. That sounds good, but Quigley thinks UH can do much better.

His goal is to build a research culture at UH and a research industry in Hawaii. To do that he needs to attract world-class principal investigators who can generate $5 million to $20 million apiece in federal grants by building teams of researchers that can execute those grants. He believes that, despite possible cuts in federal spending, the money is out there, as are the researchers. Some are already here and Quigley hints that others may be on the way next year.

Quigley talks about ?front-loading the talent? ? attracting the researchers to Hawaii before all the infrastructure is in place. Facilities such as the new Cancer Research Center and the Mauna Kea telescopes certainly help, but researchers will follow a winner, especially if Hawaii?s lifestyle is part of the mix.

Quigley?s business model is San Diego Connect, a program that began at the University of California San Diego in the mid-1980s that it says has assisted in the formation and development of more than 3,000 companies. The key to its success, according to its website, has been the ?unique culture of collaboration between industry, capital sources, professional service providers and research organizations.?

Research means jobs. One estimate suggests that a $20 million federal research grant can create 400 well-paying jobs. UH President M.R.C. Greenwood has asked the UH Economic Research Organization to develop a more precise formula, and UHERO Executive Director Carl Bonham says he?ll have one by year?s end.

Quigley is not alone in his quest for a billion dollars. Greenwood has a rich history of scientific research and funding and has been pushing the concept of UH as a predominant research university since she arrived three years ago. She, Quigley and others have been on the speaking circuit, showing how the San Diego model could lead to a Hawaii Connect. The Hawaii Business Roundtable, a group of top executives at Hawaii?s largest businesses, was a recent audience.

The Hawaii Innovation Initiative is worth noting as a state Senate committee prepares to hold hearings next week on what has been dubbed the ?Wonder Blunder? ? an ill-fated attempt by the UH Athletics Department to hold a Stevie Wonder fundraising concert and the disappearance of $200,000 that even the FBI can?t find. Whether the hearings are political posturing or a sincere attempt at uncovering some answers is not the point.

The point is that we?re spending a lot of time and energy focusing on a missing $200,000. That time and energy would be better invested in finding ways to build a billion-dollar research and innovation industry for Hawaii.

Then we would be talking real money.

DeMarco: They might be Giants ? on offense

SF's surge to NL West title fueled by huge uptick in hitting, scoring

Since the All-Star break, Buster Posey has pushed his batting average to .330 with an extended near-.400 (.388) run accompanied by a .645 slugging percentage.

OPINION

updated 11:16 p.m. ET Sept. 20, 2012

Tony DeMarco

Now that Tim Lincecum has found a slightly different way to be very effective, you're going to hear a lot about the San Francisco Giants and their pitching as a major threat entering the postseason, and rightfully so.

But as much as Lincecum has transformed himself since the All-Star break, the Giants' lineup has morphed into one that is every bit as dangerous as the rest of those in the National League playoff field.

Don't think so? Here's a number that will surprise you: Since the All-Star break, the only NL team to score more runs and have a higher OPS than the Giants are the Brewers, who, unless they can bang their way in over the next two weeks, will be at home come October.

These aren't your 2010 Giants, who unexpectedly won a World Series behind dominant pitching, didn't hit much for average, didn't steal bases, but had the uncanny knack for the clutch hit, especially the big home run.

These Giants ? with both sides of the equation coming together in a 40-23 second half ? can't be playing much better as the postseason nears.

"You'd always like to think there's another level for a team,'' Matt Cain said after the Giants' win Wednesday. "We'll keep that in mind, and not just settle.''

Here's full-season numbers and league rankings for the seven leading NL playoff contenders, followed by the numbers for just the second half of the season.

At the All-Star break, the Giants stood 12th in the NL in both runs scored and OPS. See the chart for more numbers.

As illogical as it seems in light of removing a .346 hitter and likely batting champion from the lineup, the Giants are scoring more runs per game and winning at a higher percentage without Melky Cabrera.

After Cabrera's last game Aug. 14, the Giants and Dodgers were tied atop the NL West at 64-53. Through Thursday, the Giants' lead had grown to 10 games, and their magic number was down to four.

The odd thing is the Giants are doing it despite far and away the majors' lowest total of home runs at home: just 23, or 19 fewer than the Padres' total at Petco Park. Instead of the longball, this is an offense, in Hunter Pence's words, of "random rallies at some point. Just a bunch of good at-bats in a row. We don't know when, but we'll get you."

And here is the sequence of events that has propelled them up the NL offensive ladder:

  • Buster Posey's MVP candidacy has taken off. Since the All-Star break, Posey has pushed his batting average to .330 with an extended near-.400 (.388) run accompanied by a .645 slugging percentage.
  • Marco Scutaro has played 50 games with the Giants since being acquired from the Rockies in an under-the-radar deal July 28. In that time, he has exceeded his RBI total in the first 95 games with the Rockies, knocking in 32. Scutaro also is hitting .355 as a Giant.
  • Pence's first game in a Giants uniform was July 31, and by his own admission, there have been, "a lot of bad swings, and then a good one once in a while." But his RBI total of 36 in 42 games despite a .230/.385/.688 line speaks as much about the top half of the Giants' lineup as anything.
  • Which brings us to Angel Pagan, who is doing an impressive Melk Man impression in the leadoff spot. Pagan had a .342/.415/.588 month of August with an MLB-leading 32 runs scored.
  • His September hasn't been as impressive, but he's still a .324 hitter with 45 runs scored over the past seven weeks. And don't forget breaking Willie Mays' franchise single-season record for triples with 14, plus 27 stolen bases.
  • And how about Brandon Belt's .349 batting average and .411 on-base percentage in August, and .319 batting average with 22 RBI since Aug. 1?
  • As for Lincecum, the numbers say 3-10-6.42 in the first half and 7-4-3.06 in the second. What's behind the turnaround?

The fastball velocity (averaging around 90 mph) still isn't what it used to be, and probably won't be again. But he's learned to be effective with a different mix ? more sinkers, sliders and off-speed ? and has found a better battery-mate fit in Hector Sanchez over Posey.

In the projected Giants' NLDS rotation, Lincecum lines up in the No. 3 spot, following Matt Cain and Madison Bumgarner.

Mathematicians show how shallow water may help explain tsunami power

ScienceDaily (Sep. 18, 2012) ? While wave watching is a favorite pastime of beachgoers, few notice what is happening in the shallowest water. A closer look by two University of Colorado Boulder applied mathematicians has led to the discovery of interacting X- and Y-shaped ocean waves that may help explain why some tsunamis are able to wreak so much havoc.

Professor Mark Ablowitz and doctoral student Douglas Baldwin repeatedly observed such wave interactions in ankle-deep water at both Nuevo Vallarta, Mexico, and Venice Beach, Calif., in the Pacific Ocean -- interactions that were thought to be very rare but which actually happen every day near low tide. There they saw single, straight waves interacting with each other to form X- and Y-shaped waves as well as more complex wave structures, all predicted by mathematical equations, said Ablowitz.

When most ocean waves collide, the "interaction height" is the sum of the incoming wave heights, said Baldwin. "But the wave heights that we saw from such interactions were much taller, indicating that they are what we call nonlinear," he said.

Satellite observations of the 2011 tsunami generated by the devastating earthquake that struck Japan indicate there was an X-shaped wave created by the merger of two large waves. "This significantly increased the destructive power of the event," said Ablowitz. "If the interaction had happened at a much greater distance from shore, the devastation could have been even worse as the amplitude could have been even larger. Not every tsunami is strengthened by interacting waves, but when they do intersect there can be a powerful multiplier because of the nonlinearity."

Ablowitz first observed the nonlinear wave action in 2009 while visiting Nuevo Vallarta just north of Puerto Vallarta with his family. He took hundreds of photographs and videos of the peculiar waves over the next several years.

"Unlike most new physics, you can see these interactions without expensive equipment or years of training," said Ablowitz. "A person just needs to go to a flat beach, preferably near a jetty, within a few hours of low tide and know what to look for."

A paper on the subject by Ablowitz and Baldwin was published this month in the journal Physical Review E.

Baldwin, who is studying under Ablowitz, wanted to go the extra mile to verify that the wave interactions observed by his professor were not unique to one beach. In this case he drove more than 1,000 miles to the Los Angeles area "on a whim" to search for the types of waves Ablowitz had observed in Mexico. He hit the jackpot at Venice Beach.

"I don't think there is anything more enjoyable in science than discovering something by chance, predicting something you haven't seen, and then actually seeing what you predicted," said Baldwin.

Who should replace Jose Aldo at UFC 153?

After Jose Aldo pulled out of his title defense with Frankie Edgar, the UFC was left without a main event in a fight card that is a month away. Who can fill in and face Edgar? Here are some possibilities.

Chan Sung Jung: "The Korean Zombie" is popular, an exciting fighter and will still have Brazilian fans excited to see a card that was decimated in just a few hours time. His last three fights have ended in stoppages, and his win over Dustin Poirier proved he's ready for big time.

Chad Mendes: On Tuesday, Mendes tweeted, "Let's make it for the interim title and IM IN!!" The interim title stipulation is a bit odd when it's not yet known exactly how long? Aldo will be out and unable to defend the belt.

Ricardo Lamas: He had already accepted the fight with Aldo for UFC 153 when Edgar stepped in. He has wins in his last three fights, and could be ready to go for the fight card n Rio.

Jimy Hettes: "The Kid" is undefeated and has shown he can pull out thrilling submission wins. He is scheduled to fight Marcus Brimage at UFC 152, but if there's anything this summer has taught MMA fans, it's that all fight cards are subject to change.

Godofredo Pepey: His fight record is not one that dictates main event status, but it's really, really fun to say Godofredo Pepey.

Who do you want to see in the UFC 153 man event? Tell us in the comments, on Facebook or on Twitter.

Sevcik v. Sandoval: Plaintiffs file their motion for summary judgment in

September 11, 2012

By Scottie Thomaston

The defendants and plaintiffs filed motions for summary judgment in Sevcik v. Sandoval, a federal case in Nevada (similar in a lot of ways to the Prop 8 case) challenging the state?s constitutional ban of marriage equality on equal protection grounds. Lambda Legal brought the lawsuit challenging the amendment, and at a hearing in August, the judge agreed to hear the merits of the case.

The defendants? motions were covered in the previous post.

Plaintiffs? motion

Lambda Legal filed its own motion for summary judgment in its favor. They argue first that Baker v. Nelson is not controlling. Although they point to a previous brief filed in the case to back up their claims on Baker, the motion introduces two new points: (1) Jackson v. Abercrombie, the Hawaii case, relied on a flawed analysis of Baker (2) Perry v. Brown does not suggest Baker controls this case.

The judge in Jackson, they write, suggested that Baker stands as precedent for ?all similar cases.? This is not the standard for summary dismissals ?for want of a substantial federal question.? The Supreme Court has held that these types of summary dismissals are only precedent when the precise circumstances appear. Plaintiffs write that the circumstances are not precisely the same, or even similar, ?the gulf between states like Hawaii and Nevada in 2012 (which provide same-sex couples with access to the rights and responsibilities of marriage through a second-class status) and states like Minnesota in 1972 (which afforded no relationship recognition whatsoever to same-sex couples) could hardly be greater.?

Plaintiffs draw parallels between Hawaii?s civil union law and Nevada?s domestic partnership law, suggesting that these laws matter a great deal in deciding whether the precise circumstances appear in these cases: ?a summary dismissal of a case decided on grounds ?peculiar to the situation that existed at the time of the ? court?s judgment? does not foreclose subsequent cases based on different situations.? And the introduction of a civil union law, or of a domestic partnership law, changes the legal situation that existed from the time Baker was decided.

?The question for this Court,? they write, ?therefore, is whether Baker ?necessarily decided? the issue of marriage for same-sex couples in the situation where a state simultaneously provides the same rights and responsibilities through domestic partnership.? Plaintiffs point out that the Jackson case repeatedly cited the dissent in Perry v. Brown for its ruling.

They make familiar points regarding equal protection analysis: (1) plaintiffs are similarly situated to opposite-sex couples who are legally allowed to marry (2) excluding plaintiffs from marriage discriminates against them facially and intentionally (3) plaintiffs are harmed by their exclusion from marriage, and domestic partnerships don?t cure that harm. They write that the purpose of the equal protection clause is to ensure that likes are treated alike ? people who are similarly situated should not be singled out for differential treatment without, at least, a rational reason.

But, they write, classifications based on sex and sexual orientation require a heightened form of judicial scrutiny. Admitting that the Supreme Court has not yet found it necessary to resolve the issue of the level of scrutiny required for laws discriminating against gays and lesbians, plaintiffs write that, ?[t]he Supreme Court consistently has applied heightened scrutiny where the classified group has suffered a history of discrimination, and the classification has no bearing on a person?s ability to perform in society.[...] In addition, the Supreme Court has occasionally, but not always, considered whether the group is a minority or relatively politically powerless, and whether the characteristic is defining or ?immutable? in the sense of being beyond the group member?s control or not one the government has a right to insist an individual try to change.?

They write that even High Tech Gays recognized a history of discrimination against gays and lesbians. Indeed, courts have uniformly agreed. Writing about gay and lesbian people?s ability to contribute to society, the motion suggests, ?[t]his view has long been recognized by the federal courts, and is the consensus among mainstream social scientists.? (Citing Watkins, 875 F.2d at 725.) Plaintiffs point to several cases for the claim that, ?the Ninth Circuit already has recognized and reaffirmed that sexual orientation should be considered immutable ? an understanding that conforms with the settled consensus of the major professional psychological and mental health organizations.? And the ?political powerlessness? prong of heightened scrutiny categorization relates to ?relative? political powerlessness, not absolute. Plaintiffs note only four members of Congress are openly gay, and there has never been a gay President or even a gay Cabinet-level appointee or Justice of the Supreme Court.

And, ?the legislative process has in some ways uniquely disadvantaged [gays and lesbians]. No other group has been stripped so persistently of basic antidiscrimination and family protections through the legislative and initiative process.?

And disallowing gays and lesbians to marry is also sex discrimination. ?Nevada?s restriction on marriage?, they write, ?is no less invidious because it equally denies men andwomen the right to marry a same-sex life partner. Loving v. Virginia, 388 U.S. 1 (1967), discarded ?the notion that the mere ?equal application? of a statute containing racial classifications is enough to remove the classifications from the Fourteenth Amendment?s proscription of all invidious racial discriminations.?? This has been a common argument against marriage equality: the claim that because a gay man can still marry a woman, or a gay woman can still marry a man, there is no invidious discrimination.

Next, plaintiffs suggest even if heightened scrutiny does not apply, the amendment fails under the more lenient rational basis review. They take on the standard arguments: (1) exclusion of gays and lesbians from marriage cannot be upheld because of an interest in maintaining traditional marriage or proceeding cautiously (2) moral disapproval of same-sex relationships is not a legitimate rational basis (3) exclusion of gays and lesbians from marriage does not promote responsible procreation or an interest in a child?s welfare (4) affording same-sex couples access to civil marriage does not affect religious liberty.

Regarding the first point, plaintiffs write, a law ?cannot be justified merely on the basis that it has existed for a number of years, or on the basis that, at some point in the future, a justification for the law may arise, even if one does not currently exist.? And anyway, plaintiffs argue, the institution of marriage has changed over the years, so it is hard to see how proceeding cautiously for this particular change is a rational basis. Regarding point two, Lawrence v. Texas said clearly that moral disapproval of same-sex relationships is no rational basis for a law. And as far as responsible procreation goes, citing Perry v. Brown, the plaintiffs write that, ?neither ?responsible procreation? nor encouraging childrearing by married different-sex biological parents are rationally related to a state?s exclusion of same-sex couples from marriage where state laws relating to child-rearing and procreation ?apply in the same way to same-sex couples in domestic partnerships and to married couples.?? And, they write, a state?s civil marriage license has no effect on religious practices whatsoever.

On November 26, in Nevada, the federal district court will hear oral argument on these issues. Prop 8 Trial Tracker will be covering the hearing.

(AP) ? The free-wheeling and fiery Bill Clinton who stole the show at the Democratic Party's convention showed up in Florida this week far more subdued.

The former president's temperament appeared designed to match the moment. Clinton's campaign swing on behalf of President Barack Obama coincided with two somber occasions: the anniversary of the Sept. 11 attacks and the tumultuous events in Libya that left four American diplomats dead.

In a nod to the tragedies, Clinton muted much of his direct criticism of Republican presidential nominee Mitt Romney during campaign rallies in Miami and Orlando. But he did draw sharp and detailed contrasts between Obama and Republicans on a myriad of policies, including health care, education and the debt.

Clinton never mentioned the deaths of the Americans in Libya, perhaps trying to avoid interfering with the delicate diplomacy his wife, Secretary of State Hillary Rodham Clinton, was dealing with back in Washington.

Chris Stevens, U.S. ambassador to Libya, and three diplomats were killed Tuesday as protesters overran and burned the U.S. Consulate in Benghazi.

Clinton drew about 4,300 people to the two events in Florida, building on his well-received address at last week's Democratic convention.

"What works is cooperation. What fails is constant conflict," he said Wednesday in Orlando.

Clinton was talking about Obama's economic vision, but he might as well have been talking about the complex relationship between the two men. They may not be close friends, but Obama and Clinton have bonded over the shared experience of the presidency. And they've largely healed their divisions from the 2008 Democratic primary when Obama defeated the former president's wife.

But their freshly minted political alliance comes with risks for both men.

Clinton risks denting his sky-high favorability ratings by jumping back into the political fray. He learned that lesson when he campaigned for his wife in 2008 and came across at times as angry and out of touch with the current political landscape.

Some Democrats fear that the popular Clinton could overshadow Obama. A new Pew Research Center poll found that 29 percent of those surveyed said Clinton's convention speech was the highlight of the party gathering, while just 16 percent called Obama's speech the highlight.

Clinton won praise for delivering a forceful defense of the president's economic policies and pressing the need for him to serve a second term. But the convention address revived a nagging frustration among Democrats who can't understand why Obama hasn't been able to make that case more clearly himself.

"Sometimes Obama speaks at a level that is only for the college-educated," said Ray Vera, a Florida Democrat. Vera said Clinton's convention speech compelled him to come see the former president speak Tuesday at an Obama campaign rally in Miami.

Unlike Obama, Vera said, Clinton speaks "with such calm and confidence" and in ways the average person can understand.

Obama himself joked this week that someone recommended he name Clinton "secretary of explaining stuff."

The president's aides either dismiss the risks that come with joining forces with Clinton or say they're worth taking

With Clinton, first lady Michelle Obama and Vice President Joe Biden at its disposal, the president's campaign now has three popular and persuasive surrogates who can fan out across battleground states. And Clinton shines with groups Obama sometimes struggles to connect with, particularly working-class whites and older voters.

In a true sign of Clinton's popularity, Romney has decided not to try to fight against the former president. Instead, he's trying to use him to highlight for voters what he says Obama is lacking.

"I think he really did elevate the Democrat convention in a lot of ways," Romney said Sunday on NBC's "Meet the Press." ''And, frankly, the contrast may not have been as attractive as Barack Obama might have preferred if he were choosing who'd go before him and who'd go after."

Unlike Obama, Romney can't call on his party's last occupant of the White House in this election. Former President George W. Bush remains a polarizing figure and Romney is seeking to distance himself from many of Bush's policies, both foreign and domestic. Bush didn't attend the Republican convention and isn't expected to have any role in the fall campaign.

Clinton, on the other hand, is expected to campaign for Obama frequently between now and November. He's likely to return to Florida again and is also expected to campaign in Ohio, Virginia and Iowa.

Obama's team has also put Clinton, a prolific fundraiser, to work helping them close their money gap with Romney. Obama and Clinton have teamed up for two campaign fundraisers, and the former president is also helping Priorities USA Action, the struggling Obama "super" political action committee, raise funds.

It's also something of a turnaround for Clinton, who left office with positive approval ratings for his handling of the presidency but negative ones for his personal character.

In a January 2001 Gallup/CNN/USA Today poll, 65 percent of Americans said they approved of the way Clinton was handling "his job as president," while just 41 percent said that they approved "of Clinton as a person."

Fast-forward to the present: A Gallup poll released last week showed Clinton was viewed favorably by 69 percent of Americans, including 43 percent of Republicans and 68 percent of independents. That's his highest favorability rating in polls back to 1993.

Clinton, of course, has his own motivations for his full-throated support of Obama's campaign. Those close to him say it's no secret he'd like to help pave the way for another presidential run for his wife.

Health is an important part of development, with links to how children do cognitively and academically, and it's a strong predictor of adult health and productivity. A new study of low-income families in the United States has found that children's health and access to health care services differ according to the immigrant status of their parents.

The study, by researchers at Cornell University and the University of Chicago, is published in the journal Child Development, whose September/October 2012 issue has a special section on the children of immigrants.

Although immigrants make up less than 13 percent of the total population, children of immigrants make up 22 percent of all children and 30 percent of low-income children in the United States. Because most children in immigrant families were born in the United States, they are eligible for government assistance on the same basis as all other U.S. citizens. Yet they differ in the extent to which they have health insurance and use a regular health care provider.

The study examined nationally representative data on more than 46,000 low-income children (under age 18) from the 1996, 2001, 2004, and 2008 panels of the Survey of Income and Program Participation, a Census Bureau survey. Children's immigrant status was classified according to the status of their parents as nonpermanent residents, permanent residents, naturalized citizens, or members of a native household. The study looked at the health status of the children as reported by their mothers and at whether the children saw a dentist or doctor in the past year.

Researchers found that low-income children of immigrants have significantly less good health and see doctors and dentists less often than low-income native-born children. Children with at least one nonpermanent resident parent have the poorest health and are least likely to visit a doctor or a dentist compared to all other children.

"Our findings underscore the idea that those with more precarious immigration statuses show the poorest health outcomes, and that families with noncitizen members face barriers, real or perceived, to using relevant programsin this case, health-related programs," according to Kathleen M. Ziol-Guest, a postdoctoral associate at Cornell University, who led the study.

"Noncitizen parents may be unaware of their U.S.-born children's eligibility for important benefits, or they may believe that seeking assistance for eligible children would hinder other family members' efforts to obtain citizenship or legal status, or their ability to re-enter and stay in the United States."
